Acceptance of Terms

By accessing or using Affordable Rentals ("the Platform", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the platform.

These terms apply to all users of the platform including tenants, landlords and administrators. Use of the platform constitutes full acceptance of these terms.

Description of Service

Affordable Rentals is a rental management platform that provides the following services:

• Tenant registration and account management
• Rent payment processing via M-Pesa (Safaricom)
• Digital receipt generation and email delivery
• Tenant-landlord communication through in-app messaging
• Arrears and payment history tracking
• Announcements and house rules management
• Public property listings for prospective tenants

We reserve the right to modify, suspend or discontinue any part of the service at any time with or without notice.

User Accounts

To use Affordable Rentals, you must have an account with accurate and complete information. Landlords self-register; tenant accounts are created by their landlord. You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your registered email and phone number are valid and active

We reserve the right to suspend or terminate accounts that violate these terms or provide false information.

Payments & M-Pesa

Affordable Rentals processes rent payments through Safaricom's M-Pesa Daraja platform. By making a payment you agree to the following:

• All payments are processed in Kenyan Shillings (KES)
• Payment amounts are set by your landlord and cannot be altered by Affordable Rentals
• Once a payment is confirmed by Safaricom, it is final and non-refundable unless the landlord explicitly authorises a refund
• Affordable Rentals is not responsible for failed transactions caused by insufficient M-Pesa balance, network issues or Safaricom service outages
• Your M-Pesa PIN is never stored or seen by Affordable Rentals — all PIN entry happens directly on Safaricom's secure STK Push interface

Tenant Responsibilities

As a tenant using Affordable Rentals, you agree to:

• Pay rent on or before the agreed due date
• Use the messaging feature respectfully and professionally
• Report any payment errors to your landlord promptly
• Keep your registered phone number active for M-Pesa payments
• Not share your account credentials with any other person
• Not attempt to manipulate or falsify payment records

Landlord Responsibilities

Landlords and administrators using Affordable Rentals agree to:

• Provide accurate property and rent information
• Treat all tenants fairly and without discrimination
• Respond to tenant messages within a reasonable time
• Not use the platform to harass or intimidate tenants
• Ensure all listed properties comply with applicable Kenyan housing laws
• Configure M-Pesa credentials accurately to ensure rent payments reach the correct account

Data & Privacy

We collect and store the following user data to provide our services:

• Name, email address and phone number
• Payment history and receipt records
• In-app messages between tenants and landlords
• Property and unit information provided by landlords

We do not sell your personal data to third parties. All passwords are encrypted using industry-standard bcrypt hashing. M-Pesa credentials are stored with AES-256 encryption. For full details, please read our Privacy Policy.

Prohibited Conduct

The following actions are strictly prohibited on Affordable Rentals:

• Attempting to hack, reverse-engineer or exploit the platform
• Creating fake accounts or impersonating other users
• Submitting fraudulent payment claims
• Using the messaging system to send spam or abusive content
• Attempting to access another user's account without authorisation
• Any activity that violates Kenyan law

Violation of these rules will result in immediate account termination and may be reported to relevant authorities.

Limitation of Liability

Affordable Rentals is provided "as is" without warranties of any kind. We are not liable for:

• Payment failures caused by Safaricom or network issues
• Data loss caused by unforeseen technical failures
• Disputes between tenants and landlords
• Any indirect, incidental or consequential damages

Our total liability to any user shall not exceed the amount paid by that user through the platform in the preceding 30 days.

Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms. You may also request account deletion at any time by contacting support.

Upon termination, your access to the platform will be revoked. Payment history and receipts may be retained for legal and audit purposes in accordance with applicable Kenyan law.
